Gameplay video 3rd party content

Hi,

 

I was hoping someone could help me, I recently uploaded a video of my and a friend playing some of the original halo from the MCC.  This was almost immediately hit with a 'Matched third party content' warning from Shock Entertainment Pty for the song Cloaked in blackness.  I was really hoping someone could give me some advice on this, the video isn't/wasn't monetised and I disputed the claim and it was rejected.  I have tried to contact Shock to no reply.

 

Any help is greatly appreciated.

You have every right to use that music ( if you do not monetise it )

This is 100% incorrect this is NOT fair use. 

 

I'm sorry but we cannot help you with your claim. This is something you must take up directly with the copyright holder of the song. Just reupload the video without the song or a different one if possible.

I thought that you could use copyrighted music if you credited the group or person who made it and was not monetising it?

 

So, what is fair use then?

The song is part of the sequence I would have to edit the clip and remove the sound for that entire section including a chunk of commentary.  How can i find out who the actual copyright holder is for that song?
