Actually 343/Microsoft still has all legal right to shut this down. Even if it is free they're still on shaky ground.

 

Although as long as they follow the rules(one of which is that you can't put "Halo" in the name hence why all 3 current popular Halo fangames don't have Halo in their name) then 343/MS will leave them alone, but they can strike at anytime and end this,

 

Doesn't mean they can't do the work underground in secret though but that is also very shaky and could result in even further legal action.
